This document outlines the Gia...Giamas (referred through this document as "GIA") terms and conditions and how this web location handles client, and customer data (referred through this document as "CUSTOMER"), it's use of cookies and how "GIA" uses the information that it collects about its users, customers and partners.

Collection of User Information

"GIA" collects specific information about it's users. The information that "GIA" collects is limited in scope to the following: E-mail Address, First and Last name, date of sign up. "GIA" collects this information from customers who sign up for our news letter, products, services, coupons, offerings and other events that "GIA" may hold or to help promote itself. "GIA" DOES NOT store, or retain credit card information, address information or other identifiable information about it's customers whom order or shop with us through this web location.

Usage of Customer Information

"GIA" may utilize the information collected in order to understand it's demographics and target markets based on location only when an order is purchased. Information is limited to: Geographic location, order types, e-mail and some user information. "GIA" does not process and store customer directly on it's web location. Orders are handled through a third party such as but not limited to: PayPal, Square or other processing gateways. Collection of E-Mail or Phone Number(s)

5. Cookies and Tracking Technologies Cookie Consent: If you use cookies or other tracking technologies on your site (such as for analytics or advertising), you should include a section explaining how these technologies work and how users can opt out (this is especially important for GDPR and other privacy regulations).

"GIA" will collect information about customers in various methods including our news letter sign up which is located on most of our web pages at the bottom. For the sign up of our news letter, "GIA" collects the following information: i. User Full Name, ii. User E-mail, iii. User IP Address, iv. User Signup Location (e.g: Web site, Festival, etc.) as well as potentially: browser information and geo-location information. This information is collected to provide that a user has signed up for our services voluntarily and the information is being curated from reputable sources.

Contact & Communication

By utilizing the "GIA" web site, and signing up or making purchases through "GIA" for products and services "GIA" reserves the right to periodically reach out to you via e-mail, phone or text with products, services and other offerings that you may be interested in. "GIA" WILL NOT share or distribute your contact information with third party ad agencies or, other organizations. Should you wish to opt-out of e-mail communications you may provide your name ane e-mail address on our opt-out form in order to be removed from our contact list. Please note removal from any communications list owned and operated by "GIA" will require a 30 day window as we process your request. You may receive e-mail communications in between the time you request removal until the request is processed. You will receive one last communication after removal has been successful with the subject: "GIA...GIAMAS E-mail Removal."

When collecting information about our customers "GIA" reserves the right to retain where and when a sign up or sales transaction may have occurred. This information may include but not be limited to: event, event location, date/time of sign up, geographic location of sale and other information to help provide customer engagement with said services provided and subsequent communications (e-mail, text, etc). Customers reserve the right to opt-out of any and all communications at any time with the link provided above (opt-out).

Should customers whove opted-out previously make subsequent purchases please be advised that you will be added back to the mailing list and you must opt-out again if you do not choose the "opt-out" from receiving communications.

Bookings & Fees

"GIA" reserves the right to charge 3% for credit card sales to re-coup fees incurred by the credit card vendors. "GIA" will also impose an 8.875% NYC Sales Tax on sales made within NY. Booking Fees are a one-time reservation fee that is non-refundable under any circumstances. Booking fees are set at: $125.00 for functions and events. Should the customer cancel or move an event to another time the booking fee will not be reversed. In addition to which, "GIA" reszerves the right to retain booking fees in circumstances involving or related to: bad weather conditions, illness, death, cancellations, acts of God, terror attacks, or other natural or unnatural disasters which may affect a given event "GIA" reserves the right to retain "CUSTOMER" booking fees and deposits.

Cancellation of Services

As stated in the previous segment Bookings & Fees "GIA" reserves the right to proceed with charges for events where products and services were purchased, in full should an event be cancelled, moved or another impactful event disrupts said event. If "CUSTOMER" does not cancel within a 1 (one) week period prior to the event, customer will be charged the full amount for any items purchased for the said event (this may include, ice, juices or other materials). At which point, "GIA" will ship any juices promised within the booking form to "CUSTOMER."

Orders & Returns

"GIA" requires that all orders be purchased by an adult aged eighteen (18) years or older, with a valid credit card or other form of payment. "GIA" reserves the right to cancel any and all orders which may violate this provision and, any orders which may indicate fraudulent charges (e.g: conflicting billing/shipping information)

Should "CUSTOMER" not be satisfied with the product, they may request a return or, replacement of the product purchased. "CUSTOMER" agrees that "CUSTOMER" pay any return, postage, packing and restocking fees imposed under this return section. Customer may return any products that are defective or, they are unsatisfied with by utilizing any of the following carrier options: USPS, UPS, FedEx when filing a return please fill out and print the Return Document so that we may process your return effectively. PLEASE NOTE Do not include any billing or other information such as credit card, checking or other financial information within this document or return shipment. We will not be liable for any lost/stolen packages that contain such information. Should we require any information such as credit card info. a "GIA" representative will contact you once your return is received.
